Wrongful Death

The law offices of Kadanoff & Kadanoff, PLLC has extensive experience and success prosecuting wrongful death actions and for over 4 decades, has helped grieving families find justice and financial stability after the tragic loss of a loved one.

What could be worse than experiencing the death of a loved one?  The lasting impact it has on family, friends and associates. What is worse is the death of a loved one that could have been avoided and was unnecessarily caused by the carelessness of another. We understand that the tragedy continues far beyond the actual death of the victim. We also understand that the devastating emotional loss, loss of income and loss of companionship and guidance suffered by the surviving family members cannot be measured.

When a person dies unnecessarily through the carelessness of a healthcare provider, driver of an automobile or other careless act that causes the death of an individual, the surviving spouse, children or next of kin are entitled to be compensated fully for the pain and suffering the victim or patient might have suffered prior to death, the loss of companionship and the loss of future income of the deceased that the family depended on to survive. The death of an individual without income does not preclude the appropriate family member from bringing a wrongful death action. Every life is valuable.

Kadanoff & Kadanoff, PLLC has vast experience and sensitivity in handling a wrongful death lawsuit, and while your family grieves, we will handle every aspect of the case, including preparation and filing of the necessary papers in Surrogate’s Court to appoint a representative of the Estate to initiate the lawsuit.

Medical Malpractice

What is Medical Malpractice?

Essentially, medical malpractice occurs when a medical professional, health care provider or facility, such as a physician, hospital, nurse or clinic fails to provide the appropriate standard of care to a patient, causing severe injury, illness, or death. There are medical standards set by the medical community, which doctors must follow.

Simply stated, The law firm of Kadanoff & Kadanoff, PLLC will  recover monetary damages for you, when we prove that your doctor or other health care provider deviated from good and accepted medical practice in his treatment of you, and that such failures caused or contributed to your injuries.

A victim of medical malpractice is entitled to compensation for pain and suffering, which is usually permanent and chronic, loss of wages and for the inability of the claimant to do the things he or she was able to do prior to the negligence of the doctor or “loss of enjoyment of life.”

Medical malpractice claims are complex and require expert testimony to establish both the negligence of the medical professional or institution, and what should have been the appropriate care in each individual case.

Typically, the statute of limitations in New York is 2 ½ years from the date of the malpractice, but it might be extended under particular circumstances.

Therefore, if you feel you or a loved one has been a victim of a medical mistake, it is critical that you call and meet with us at Kadanoff & Kadanoff, PLLC for a free consultation so that we can determine if the statute has run in your particular case and to have your claim evaluated by our expert attorneys in the field of medical negligence to insure that your rights are protected. In the case where the victim of malpractice is disabled, an attorney will come to your home and meet with you to discuss the claim.
